Does life insurance count toward estate tax?

Updated October 8, 20263 sourcesCoverfolk teamFact checked
The short answer

Yes, it can. The IRS counts the payout in your estate if it goes to your estate or if you owned the policy when you died. Most people still owe no federal estate tax because the limit is high.

Income tax and estate tax are not the same. Your beneficiary usually pays no income tax on the payout. Estate tax is a different tax on everything you leave behind.

The IRS counts life insurance in your estate in two cases. One is when the money is paid to your estate. The other is when you held rights in the policy, like the power to change the beneficiary, cancel it or borrow from it.

The federal limit is high. For deaths in 2026, the IRS filing threshold is $15,000,000. For 2025 it was $13,990,000. Estates below this usually do not file or pay.

Money left to a husband or wife can qualify for the marital deduction. That lowers the part of the estate that is taxed.

If you give your policy away, the IRS still counts it if you die within 3 years. People with large estates often use a life insurance trust to plan ahead.

  • Paid to your estate: counted
  • You owned the policy at death: counted
  • Given away within 3 years of death: counted
  • Owned by a properly set up trust: usually not counted
