Medicaid and burial money

Georgia law makes all burial contracts sold in Georgia revocable, and Medicaid treats irrevocable ones the same. Many aged, blind, and disabled groups (non FBR, such as nursing home Medicaid) can keep up to $10,000 total for burial. That counts life insurance face value, burial funds, and burial contracts, minus paid up burial space items. SSI type (FBR) groups can keep up to $1,500.

Prepaid funeral plans

The Georgia Secretary of State regulates preneed sellers. Sellers must put 100% of the price of funeral services and cash advance items in trust. Caskets need 100% of price, never less than 110% of wholesale. Vaults and monuments need at least 35%. If you ask for a refund before death, the seller must pay within 3 business days. The seller can keep a fee of the lesser of 10% or half the interest.
