Medicaid and burial money
Medical Assistance does not count money placed in an irrevocable itemized funeral contract for your own funeral, or the interest it earns. If burial is paid by an insurance policy, the amount counted as set aside is the lower of the cost basis or the face value. Money not used for the funeral goes back to the estate and can be recovered by the state (N.D. Cent. Code 50-24.1-02.3).
Prepaid funeral plans
The insurance commissioner oversees preneed funeral contracts. 100% of money paid for funeral services and goods, and 50% for cemetery merchandise, must be deposited in an insured North Dakota account within 10 days. The payer can ask for the money back before death. You can cancel the irrevocable part of an irrevocable itemized contract within 45 days (N.D. Cent. Code 43-10.1-03.1).
