Medicaid and burial money
For OSIP and OSIPM, up to $1,500 set aside for burial is not counted for you and $1,500 for your spouse. It must be in its own account. Life insurance already excluded and irrevocable burial plans lower that $1,500. An irrevocable burial trust or plan is not counted at all.
Prepaid funeral plans
The Department of Consumer and Business Services regulates prepaid funeral contracts. For a guaranteed contract, the seller can keep 10% and must put 90% in trust within 5 business days. For a nonguaranteed contract, 100% goes in trust. You can cancel any time before death, unless the contract is irrevocable, and get back what you paid plus the trust earnings, minus goods and services already delivered.
